Terms of Service

1Agreement to Terms

When you use OfferPath, you're agreeing to these terms. Pretty standard stuff.

OfferPath is run by ScaleUp Ventures. Throughout this document, "we" or "us" means OfferPath and ScaleUp Ventures. "You" means you, the person using our service.

If you don't agree with these terms, please don't use OfferPath.

We might update these terms occasionally. If we make big changes, we'll post the new version here with a new date. If you keep using OfferPath after we update the terms, that means you're okay with the changes.

2Service Description

Here's what OfferPath does for you:

  • We find jobs that match what you're looking for
  • We apply to those jobs on your behalf using your resume and info
  • We keep you updated through team chat and daily updates
  • We help you track where you've applied

Here's what we need to be clear about: We handle the applications, but we can't guarantee you'll get hired. Whether you land a job depends on your experience, what employers are looking for, and how the market is doing. We're here to get your applications in front of employers—the rest is up to how well you match what they need.

3Eligibility

To use OfferPath, you need to:

  • Be at least 18 years old
  • Give us accurate information about yourself
  • Either have the right to work where you're applying, or be looking for visa sponsorship
  • Have a working email and phone number

4User Accounts

Your account is your responsibility. This means:

  • Tell us the truth about who you are
  • Keep your password safe and don't share it
  • Let us know right away if someone else gets into your account
  • You're responsible for anything that happens with your account

If you break these rules or lie to us, we might pause or close your account.

5Authorization to Apply

When you use OfferPath, you're giving us permission to:

  • Apply to jobs for you using your resume and info
  • Set up accounts on job boards and company sites when needed
  • Talk to employers about your applications
  • Use your resume, cover letter, and other materials you give us

By giving us this permission, you're confirming that everything you tell us is true and that you're okay with us applying to jobs on your behalf.

6User Responsibilities

Please don't:

  • Lie or give us fake information
  • Use OfferPath for anything illegal
  • Pretend to be someone else
  • Try to mess with or break our service
  • Try to hack into our systems
  • Use other job application services at the same time (this creates duplicate applications that hurt your chances)
  • Share your login with other people

7Payment Terms

Our Guarantee: Every plan comes with our Job Offer Guarantee. If you land a job before we use all your applications, we'll refund you for the ones you didn't use.

How Payment Works: You pay upfront when you subscribe. We bill weekly, and your subscription automatically renews each week unless you cancel.

Pricing: You can see current prices on our website. If we ever change prices, it won't affect your current subscription—only future renewals.

8Cancellation

You can cancel anytime from your account dashboard or by emailing hello@offerpath.co. Here's what happens when you cancel:

  • Your service stays active until the end of your current billing week
  • After that, we stop submitting new applications
  • You can still log in to see your application history
  • We don't give partial refunds for days you didn't use

9Intellectual Property

We own OfferPath—the website, the design, and how everything works. You can't copy it, change it, or use it to build your own competing service without our written permission.

Your resume and personal info? That's yours. You keep ownership. By using OfferPath, you're just letting us use your materials to apply to jobs for you. That's it.

10Disclaimers

We need to be honest about what we can and can't promise:

  • We can't guarantee you'll get hired or get interviews
  • Our service might have occasional bugs or downtime
  • Job postings come from other companies—we can't verify everything is accurate
  • We can't control whether employers actually look at your application

We work hard to give you a great service, but we can't make promises about things outside our control—like whether employers respond or hire you.

11Limitation of Liability

Here's the legal protection we need: If something goes wrong with OfferPath, we're not responsible for indirect problems—like if you lose out on a job opportunity or lose money because our service had an issue.

If you have a valid claim against us, the most we'll pay is what you paid us in the past 6 months. That's our maximum liability.

This might sound harsh, but it's standard for services like ours. We need these protections to stay in business and keep offering the service at a fair price.

12Indemnification

If you cause a problem that gets us in legal trouble, you'll cover our costs. This includes if:

  • You misuse OfferPath
  • You break these terms
  • You violate someone else's rights
  • You give us false information that causes issues

Bottom line: If your actions create legal problems for us, you're responsible for the costs (including lawyer fees).

13Governing Law & Disputes

If we have a legal disagreement, Delaware law applies.

Instead of going to court, we'll use arbitration—a neutral third party will hear both sides and make a decision. This is usually faster and cheaper than a lawsuit.

You also agree to handle disputes individually, not as part of a class action lawsuit. This means if there's an issue, it's between you and us—not you and a big group of other users.

14Termination

If you break these terms, we can pause or close your account. If that happens:

  • You'll lose access to OfferPath immediately
  • We might delete your account data (following our Privacy Policy)
  • Some parts of these terms (like payment obligations) still apply

We don't want to do this, but we need the ability to remove users who violate the rules.

15Miscellaneous

The Complete Agreement: These terms, along with our Privacy Policy, are the full agreement between you and OfferPath. Nothing else applies.

If Part Is Invalid: If a court says one part of these terms isn't valid, the rest still applies.

Being Flexible: If we don't enforce something one time, that doesn't mean we've given up the right to enforce it later.

Transferring Rights: You can't transfer your OfferPath account to someone else without asking us first. We can transfer our rights to another company if needed (like if we get acquired).
